While it is suggested in the Judgment that the Clamant might have succeeded in showing that the vehicle was a piece of work equipment that had not been maintained in efficient working order, this was not pleaded and there is no explicit reference in the Judgment to the Provision and Use of Work Equipment Regulations. The Judgment in this claim includes several references to regulation 4 of the Manual Handling Operations Regulations. There was found to be a breach of regulation 4 that was not causative of the injury the Claimant sustained.
