In this case, a Resources Technician in a secondary school sought damages for "a discrete injury" which allegedly arose in March 1993 and was caused by the typing she performed on an Apple Mac computer. The Plaintiff was said by her medical expert to have suffered an Intersection Syndrome and the aggravation of a Piso-triquetral Arthrosis. In his Judgment, Mr Recorder Black QC found the Defendant was in breach of the duty of care and that the Intersection Syndrome was causally linked to that breach of duty.
Even though the Plaintiff performed the allegedly injurious work for a short period after January 1993, there is no reference in the Judgment to the DSE Regulations which it seems were not pleaded in this case. This case does not appear to have received any coverage in the national press.
