Asprey - v - The Post Office | 6 Jul 1994 | Guildford County | Asprey | Keyboard use: post code entry | Focal Dystonia | Defendant |
The start of the trial of this case was reported in the Daily Express on the 12th April 1994, under the headline Postie's pain cost him sorting job. This appears to be a brief report of the opening speech by Plaintiff's Counsel in which the Plaintiff's case was outlined. The Plaintiff was described in this report in the Daily Express as "developing repetitive strain injury" from sorting 2,000 letters per hour during the Christmas rush. In fact, the Plaintiff's case was that he had suffered "a work related upper limb disorder (PDA4)" from entering post codes. The Judgment some months later, in July 1994, shows that despite convincing the Court that he had suffered "a focal dystonia, otherwise known as occupational cramp" due to his work, the Plaintiff failed to prove the Defendant was negligent. The successful defence of this claim does not appear to have received any press coverage.
